These Terms of Service (“Terms”) govern your access to and use of the website, mobile site, and related services offered by [Vespera Homes / Legal Entity Name] (“Vespera Homes”, “we”, “us”, or “our”). By visiting, creating an account, or purchasing from our Site, you agree to be bound by these Terms as well as our Privacy Policy and Returns & Exchanges Policy. If you do not agree, please do not use the Site.

This document is an electronic record under the Information Technology Act, 2000 and applicable rules. It is generated by a computer system and does not require physical or digital signatures.

1) Eligibility & Account

  • You must be 18+ (or the age of majority in your jurisdiction) to purchase.

  • You are responsible for safeguarding your account credentials and for activities performed under your account.

  • You agree to provide accurate, current, and complete information.

2) Right to Change

We may update these Terms from time to time. The “Last updated” date shows the latest version. Continued use of the Site after changes constitutes acceptance of the revised Terms.

3) Electronic Communications & Records (India)

When you use the Site or contact us, you communicate with us electronically and consent to receive communications from us by email, SMS/WhatsApp, phone, in-app notices, or by posting on the Site. You agree such communications satisfy any legal requirement that they be in writing (per the IT Act, 2000).
Outbound communications: By sharing your contact details or placing an order, you consent to receive service and promotional messages/calls from us. You may opt-out of promotional messages at any time (reply STOP, use unsubscribe links, or email [hello@vesperahomes.com]).

4) Privacy

Your use of the Site is also governed by our Privacy Policy. We may process your information outside India through trusted service providers (e-commerce platform, payments, logistics) with reasonable safeguards.

5) Products, Colors & Content

We strive to display products and finishes accurately; actual colors/finishes may vary due to device settings and handcrafted processes. Product measurements are approximate.

6) Pricing, Taxes & Errors

  • Prices are shown in INR and may be inclusive/exclusive of taxes as indicated at checkout.

  • Shipping, duties, fees (if any) are calculated at checkout based on delivery address.

  • We may correct typographical errors or omissions (price, description, availability) and cancel or refuse orders affected by such errors; if payment was captured, we will refund accordingly.

7) Orders & Cancellation by Vespera

We may limit quantities and refuse or cancel any order (in whole/part) for reasons such as limited stock, payment/verification issues, suspected fraud, errors, or quality concerns. If cancelled after payment capture, we will refund to the original method (or as otherwise communicated).

8) Payments

Payments are processed by third-party gateways; we do not store full card details. By paying, you represent you are authorised to use the method and authorize us and our processors to charge the order total. We may request KYC/ID verification before dispatch.

9) Shipping, Delivery & Risk of Loss

Shipping options and ETAs are shown at checkout and on our Shipping & Delivery page. Timelines are estimates, not guarantees. Title and risk pass to you upon delivery to the address provided. If delivery fails due to an incorrect address, unavailability or refusal to accept, parcels may return to us; re-shipping charges may apply and refunds (if any) may exclude original shipping/COD fees.

10) Returns, Exchanges & Refunds (Summary)

Please read our Returns & Exchanges Policy for full details. In brief:

  • Refunds are issued if a product is unavailable from our end.

  • Returns or Exchanges may be requested within 7 days of delivery, case-by-case and subject to item condition and availability.

  • Damaged/incorrect items: notify us within 48 hours of delivery with clear photos of the outer box (with label), inner packaging and the item; we’ll arrange a resolution as per policy.

  • Original shipping/COD fees (if any) are non-refundable, unless the return is due to our error.

11) Cancellations by Customer

12) Gift Cards & Credit Notes (if applicable)

Gift cards/store credit are non-refundable, non-transferable, redeemable only on our Site (subject to validity), and cannot be used to purchase other gift cards. If an order exceeds the gift card value, the balance must be paid via another method.

13) Promotions & Registry (optional)

Promotional offers are time-bound and may carry additional terms. If we introduce registry features, their specific T&Cs will apply in addition to these Terms.

14) User Content & Reviews

By submitting reviews, photos, comments or other content, you grant Vespera Homes a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, publish, translate, distribute and display such content for our business and marketing. You represent you own or control the rights in such content and that it is lawful.

15) Acceptable Use & Prohibited Content (India)

You agree not to host, upload, publish, transmit or share any content that:

  • belongs to another person without rights or consent;

  • is harmful, defamatory, obscene, invasive of privacy, hateful, ethnically objectionable, or otherwise unlawful;

  • infringes intellectual property or violates any law; impersonates another person;

  • contains viruses/malicious code or attempts to gain unauthorized access; or

  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or incites a cognisable offence.
    We may remove content, suspend/terminate accounts and pursue legal remedies for violations.

16) Intellectual Property & Takedown

All Site content (text, images, graphics, logos, designs, code) is owned by or licensed to Vespera Homes and protected by law. You may not copy, modify, distribute, create derivative works, or exploit the content without our prior written consent.
IP complaints: If you believe your IP has been infringed on our Site, contact our Grievance Officer with (a) details of the work, (b) the allegedly infringing URL/material, (c) proof of ownership/authorization, and (d) your contact details. We acknowledge within 48 hours and aim to resolve within one month.

17) Third-Party Services & Links

The Site may link to or integrate third-party services (payments, shipping, analytics, social media). We are not responsible for those services or their policies; please review their terms and privacy notices.

18) Warranty Disclaimer

Except as expressly stated, the Site and products are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free.

19) Limitation of Liability

To the maximum extent permitted by law, Vespera Homes (and its officers, employees, affiliates) shall not be liable for any indirect, incidental, special, consequential, punitive damages or for loss of profits, revenue, data or goodwill arising from your use of the Site or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

20) Indemnity

You agree to indemnify and hold harmless Vespera Homes from any claims, losses, liabilities, damages, costs and expenses (including legal fees) arising from your breach of these Terms, misuse of the Site, or violation of law or third-party rights.

21) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (including acts of God, pandemics, strikes, labour disputes, disruptions of logistics/carriers, governmental actions, or network outages).

22) Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Courts at New Delhi, India shall have exclusive jurisdiction.
(Optional – Arbitration) Any dispute may be resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator; seat/venue: New Delhi; language English.

23) Severability, No Waiver & Entire Agreement

If any provision is held invalid, the remainder remains in full force. Our failure to enforce any right is not a waiver. These Terms, together with policies referenced herein, constitute the entire agreement between you and Vespera Homes regarding the Site and your purchases.
